Terms of Service

These Terms of Service ("Terms") govern your access to and use of Horux's service monitoring platform ("Service"). By accessing or using our Service, you agree to be bound by these Terms.
1. Account Registration
- You must provide accurate and complete information when creating an account
- You are responsible for maintaining the security of your account credentials
- You must be at least 18 years old to use our Service
- One person or legal entity may not maintain more than one free account
2. Acceptable Use
You agree not to:
- Use the Service for any illegal purpose or violate any laws
- Attempt to gain unauthorized access to our systems or other users' accounts
- Transmit viruses, malware, or any malicious code
- Use the Service to harass, abuse, or harm others
- Reverse engineer or attempt to extract the source code of our Service
- Exceed usage limits or attempt to overwhelm our infrastructure
3. Service Availability
- We strive for 99.9% uptime but do not guarantee uninterrupted access
- Scheduled maintenance will be announced in advance when possible
- We reserve the right to modify or discontinue features with notice
4. Payment Terms
- Paid plans are billed monthly or annually in advance
- All fees are non-refundable except as required by law or stated in our refund policy
- Failed payments may result in service suspension after a grace period
- Price changes will be communicated at least 30 days in advance
- You may cancel your subscription at any time; service continues until the end of the billing period
5. Data Ownership and Usage
- You retain all ownership rights to your monitoring data, metrics, and logs
- You grant us permission to process and store your data to provide the Service
- You are responsible for the accuracy and legality of data you upload
- We may use aggregated, anonymized data for service improvement and analytics
6. Limitation of Liability
Important: Please read this section carefully as it limits our liability to you.
To the maximum extent permitted by law:
- The Service is provided "as is" without warranties of any kind
- We are not liable for indirect, incidental, or consequential damages
- Our total liability shall not exceed the amount you paid us in the past 12 months
- You are responsible for maintaining backups of your critical data
7. Account Termination
We may suspend or terminate your account if:
- You violate these Terms or our Acceptable Use Policy
- Your account has been inactive for over 12 months
- Payment fails repeatedly
- We are required to do so by law
Upon termination, your access to the Service will cease, and your data will be deleted according to our retention policy.
8. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service at least 30 days before they take effect.
Continued use of the Service after changes take effect constitutes acceptance of the modified Terms.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of The Netherlands, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of The Netherlands.
